ACCEPTANCE OF TERMS OF SERVICE
SportsInteractive.com ("SPX"), owned and operated by JohnRobertMorris.com,
offers virtual gaming, fantasy pools, forums, surveys, and the SportsInteractive
Membership Benefits (the "Service") to you subject to these Terms of Service ("TOS")
(any of which may be updated by SportsInteractive without notice).
You understand that the Service may include advertisements and that
these advertisements are necessary for SPX to provide the Service.
You also understand and agree that the Service may include certain communications
from SPX, such as email verifications, lost password requests, public announcements,
and administrative messages, which are considered part of SPX membership
and you will not be allowed to opt out of receiving them.
ANY PARTICIPATION OF THE SUPPLIED SERVICES OR THE USE OF THE MEMBERSHIP
BENEFITS WILL CONSTITUTE ACCEPTANCE OF THIS AGREEMENT. IF YOU DO NOT
AGREE TO ABIDE BY THE ABOVE, PLEASE DO NOT PARTICIPATE ON THIS WEBSITE.

USER ID REQUIREMENT
To participate in the SPX services, you must have a valid SPX ID.
If you do not have a SPX ID, you will be prompted to sign up for one using a
valid email address and complete the registration process, at which point
you will receive a password and account designation.
You are responsible for maintaining the confidentiality of the password and account,
and are fully responsible for all activities that occur under
your password or account. You agree to (a)
immediately notify SPX of any unauthorized use of your password or account or
any other breach of security, and (b) ensure that you exit from your account at
the end of each session. SPX cannot and will not be liable for any loss or
damage arising from your failure to comply with this USER ID REQUIREMENT.

DONATION TERMS FOR MEMBERSHIP BENEFITS
Your donation (an act of monetary goodwill towards the site that does not guarantee
"services" nor will be considered a contract for "guaranteed services" which includes
but is not entirely exclusive of downloadable statistics, odds or any other service
provided by SPX) for the Membership Benefits package of your choice gives you access
to the features of that particular package from the time you sign up through to the
expiry date of your membership. The credit card that you provide as part of your
registration data will automatically and immediately be billed for the Membership
Benefits package you request. All currency references are in U.S. dollars.
Please note that your donation for Membership Benefits is non-refundable,
and you may not cancel your donated Membership.

TERMINATION
If (a) your credit card is invalid for any reason, (b) you charge back to your
credit card the fees due under these Additional Terms, (c) it appears you have
engaged in cheating or manipulation of the Service, or (d) SPX otherwise believes
you have acted in a manner inconsistent with the spirit of this website or these
Terms, your SPX account may be suspended or cancelled immediately and all information
contained within it immediately deleted or made inaccessible. SPX may, but has no
duty to, immediately terminate your access to the Service if SPX in its sole opinion
concludes that you have provided false information in connection with your
registration data. SPX accepts no liability for information that is deleted
due to the termination of your account.

ACCURACY OF INFORMATION
ALL STATISTICS AND OTHER INFORMATION PROVIDED THROUGH DOWNLOADABLE STATISTICS
AND THE MEMBERSHIP BENEFITS ARE UNOFFICIAL. Downloadable statistics, and
their respective components are offered for informational and/or entertainment
purposes only. While SPX and the third parties used to provide the downloadable
statistics (the "Third Party Providers") use reasonable efforts to include
accurate and up-to-date information, neither SPX nor its Third Party Providers
warrant or make any representations of any kind with respect to the information
provided to you through the free downloadable statistics and/or the Membership
Benefits Services.
SPX and its Third Party Providers shall not be responsible
or liable for the accuracy, usefulness or availability of any information
transmitted or made available via the free downloadable statistics and/or
the Membership Benefits, and shall not be responsible or liable for any error
or omissions in that information.

ENTERTAINMENT PURPOSES ONLY
All downloadable statistics are for entertainment purposes only and may not
be used in connection with any form of gambling or wagering.

CONTENT SUBMITTED OR MADE AVAILABLE FOR INCLUSION ON THE SERVICE
SPX does not claim ownership of the Content you submit or
make available for inclusion on the Service. However, with respect to Content
you submit or make available for inclusion on publicly accessible areas
of the Service other than SPX Messaging, you grant SPX world-wide,
royalty free, non-exclusive, irrevocable and fully sublicensable
license to use, distribute, reproduce, modify, adapt, publish, translate, publicly
perform and publicly display such Content (in whole or in part) and to incorporate
such Content into other works in any format or medium now known or later developed.
"Publicly accessible" areas of the Service are those areas of SPX
that are intended by SPX to be available to the general public.
By way of example, publicly accessible areas of the Service would
include SPX Virtual Gaming, Forums, Journals, Surveys and Pools
that are open to both members and visitors. However, publicly
accessible areas of the Service would not include SPX services
intended for private communication such as SPX Messaging or the SPX Chatterbox.

COLLECTION OF PERSONAL INFORMATION
By signing up for your SPX membership, you agree to SPX's use of your personal
information as per SPX's Privacy Policy.

RESERVATION OF RIGHTS
SportsInteractive.com expressly reserves the right to immediately modify, suspend
or terminate your account and refuse current or future use of any SPX service (or
any portion thereof), including the downloadable statistics or the Membership
Benefits, if SPX, in its sole discretion:
- believes you have violated or
tried to violate the rights of others;
- becomes aware of information indicating
a safety concern for you, other SPX users, or the general public, or
- believes
that you have acted inconsistently with the spirit or the letter of these Terms
The services and Membership Benefits are offered at the discretion of SPX, and SPX
has the right to modify or discontinue, temporarily or permanently, the SPX services
or the Membership Benefits, in whole or in part for any reason, with or without
notice to you.
You agree that SPX will not be liable to you or to any third party
for any modifications or discontinuance of the SportsInteractive services or the
Membership Benefits.

INDEMNITY
You agree to indemnify and hold harmless SPX, and its subsidiaries, affiliates,
officers, agents, or other partners, and employees, from any claim or demand,
including reasonable attorneys' fees, made by any third party due to or arising out
of your use of, or participation in, SPX's services or any Membership Benefit, your
connection to the SPX's services or any Membership Benefit, your violation of these
Terms, or of any rights of another person or entity.

The Service may provide, or third parties may provide, links to other World
Wide Web sites or resources. Because SPX has no control over such sites and
resources, you acknowledge and agree that SPX is not responsible for the
availability of such external sites or resources, and does not endorse and is
not responsible or liable for any Content, advertising, products, or other
materials on or available from such sites or resources. You further acknowledge
and agree that SPX shall not be responsible or liable, directly or
indirectly, for any damage or loss caused or alleged to be caused by or in
connection with use of or reliance on any such Content, goods or services
available on or through any such site or resource.

NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit
for any commercial purposes, any portion of the Service (including your SPX ID),
use of the Service, or access to the Service.

MODIFICATIONS TO SERVICE
SPX reserves the right at any time and from time to time to modify, remove or
discontinue, temporarily or permanently, the Service (or any part thereof) with
or without notice. You agree that SPX shall not be liable to you or to any
third party for any modification, suspension or discontinuance of the
Service.

INVALIDITY OF SPECIFIC TERMS
If any provision of these Terms or any document incorporated by reference is found
by a court of competent jurisdiction to be invalid, the parties nevertheless agree
that the court should endeavour to give effect to the parties' intentions as reflected
in the provision, and the other provisions of such documents remain in full force and
effect.

LOCATION OF LAWSUIT
The SPX's TOS, which apply to your use of SPX's services and the Membership Benefits,
provide that both you and SPX agree to submit to the personal and exclusive jurisdiction
of the courts located within the Boundaries of Vancouver, Canada. The Federal Laws of
Canada, without regard to its conflicts of law provisions, will govern the SPX TOS,
any Additional Terms and the relationship between you and SPX.

TRADEMARK INFORMATION
The SportsInteractive, SportsInteractive.com, SportsInteractive logo,
SPX Chatterbox, SPX Messaging, SPX Virtual Gaming, SPX Pools, SPX Surveys,
SPX Stats, SPX Links, SPX Journals, SPX Buddy Lists
and SportsInteractive logo (in Japanese Characters) are trademarks
and service marks and other SPX logos and product and service names
are trademarks of SportsInteractive.com (the "SPX Marks").
Without SPX's prior permission, you agree not to display or use in any manner,
the SPX Marks.

WHAT TO DO IF YOU WITNESS A VIOLATION
If you witness any user activity in SPX that violates the TOS, posted guidelines or
any SPX rules in effect, please notify us of the activity via a message to the SPX
Administration. SPX cannot guarantee that any action will be taken as a result of
your email, but we appreciate your help in making the service a fun place for everyone.
